1. Scope and Provider
These Terms of Service govern the use of the “Textile Platform” web application (the “Platform”), operated by Brunold Software, Damian Brunold, Säntisrain 11, 8820 Wädenswil, Switzerland (the “Provider”). By registering for or using the Platform, the user accepts these terms.
2. Service
The Platform allows users to create, upload, edit and share weaving and bead patterns (DB-WEAVE and JBead). Use is free of charge. There is no entitlement to availability, specific features or the continued operation of the Platform. The Provider may modify, restrict or discontinue the service at any time without prior notice.
3. Registration and User Account
A user account is required for most features. The information provided must be truthful. The user is responsible for keeping the password confidential and for all activity under the account. The Provider may suspend or delete accounts at any time without giving reasons, in particular in case of breach of these terms.
4. User Obligations
The user undertakes not to upload or publish content that infringes applicable law, third-party rights (in particular copyright, personality and trademark rights) or public morals. The user is solely responsible for their content.
5. Rights to Content
The user retains all rights to content they upload. The user grants the Provider a non-exclusive, worldwide, royalty-free licence to store, display and – to the extent released by the user – make this content available to other users, solely for the purpose of operating the Platform.
6. Warranty and Liability
The Platform is provided “as is”, without any warranty. To the maximum extent permitted by law, the Provider disclaims all warranties, in particular with regard to availability, absence of errors, data integrity, fitness for a particular purpose and data loss.
To the maximum extent permitted by law, the Provider's liability is excluded in any case, including for indirect damages, consequential damages, lost profits and loss of data. Mandatory statutory liability (in particular for gross negligence or wilful misconduct) remains unaffected. Users are responsible for keeping their own backups of their patterns.
7. Privacy
The Privacy Policy applies.
8. Changes
The Provider may amend these terms at any time. The current version applies to continued use of the Platform.
9. Governing Law and Jurisdiction
Swiss law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the exclusive place of jurisdiction is Wädenswil, Switzerland.
10. Severability
If any provision is found to be invalid, the validity of the remaining provisions remains unaffected.
